Terms of Service

These Terms of Service ("Terms") govern your use of Birln Wall, a call- and text-screening service provided by Phlout LLC("we", "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Birln Wall.

1. The service

Birln Wall issues you a screened phone number. Calls and texts from people on your approved list connect to you directly. Callers who are not on your list are answered by our automated system and asked to pay a one-time fee to connect; once they pay, they are added to your list for future calls. You control your approved list.

2. Eligibility & your account

You must be at least 18 years old and able to form a binding contract to use Birln Wall. You are responsible for activity under your account and for keeping your device and login secure. You agree to provide accurate information and to use the service in compliance with all applicable laws.

You can close your account at any time from inside the app (Call Guard → Delete account). Deleting your account releases your screened number, removes your approved list and settings, and deletes your data as described in our Privacy Policy; records we must keep for legal, tax, or dispute purposes (such as payment records) may be retained as required.

3. The connect fee

The connect fee is a one-time charge paid by an unknown caller to reach you — set by the recipient, with a default of $2.99. It is a transactional fee for connecting a single caller; it is not a subscription, deposit, security, or stored-value product, and it carries no surrender value. Payments are processed by Stripe; by paying, the caller also agrees to Stripe's terms. We may change the fee amount, and we will reflect any change at the point of payment before a caller is charged.

4. Getting paid (payouts)

When a caller pays the connect fee to reach you, you receive 80% of that fee and Phlout LLC retains a 20% platform fee. To receive your share, you must set up payouts in the app, which creates a payment account for you with Stripe (our payments provider) and requires you to complete Stripe's identity and bank verification. Your share of each connect fee settles directly to your Stripe payment account and is paid out to your linked bank account on Stripe's standard payout schedule; by setting up payouts you also agree to Stripe's connected-account agreement.

Payment collection agent.You appoint Phlout LLC as your limited payment-collection agent solely for the purpose of accepting the connect fee from callers on your behalf. A caller's payment of the connect fee to Phlout LLC is considered the same as a payment made directly to you, and satisfies the caller's obligation to you for that connection. If you have not completed payout setup, unknown callers are screened without being offered the paid connect option, so no fees are collected on your behalf.

You are responsible for any taxes on amounts you receive. Stripe or Phlout LLC may provide tax forms (for example, a 1099) where required by law.

5. Refunds & disputes

If a caller is charged the connect fee but a connection genuinely could not be completed due to a fault in our service, the caller may request a refund of that charge by emailing help@birlnwall.com with the calling number and approximate time. We review refund requests in good faith. For payment disputes, contact us first so we can help resolve the issue quickly.

6. Paid subscriptions (optional)

Birln Wall's core screening — your screened number, your approved list, blocking, and basic voicemail — is free. We also offer optional paid subscriptions, purchased through your app store. Subscriptions renew automatically until cancelled in your app store account settings, and refunds for these purchases are handled by the app store.

Birln Wall Plus.Plus adds delivery and convenience features that cost us money to run for each use: voicemails delivered to you by text and email, full voicemail-to-text transcripts, and the "expecting a call" feature that uses automated analysis of what a caller says to let callers you are expecting through for free. Plus does not change how the wall itself screens calls, and cancelling Plus never disables your screening, your approved list, or your ability to receive voicemail. Plus is subject to the usage limits in section 7.

Data removal. Birln Wall offers an optional paid service that removes your information from data-broker and people-search sites. The removals are performed by a third-party removal provider acting on your behalf. Coverage and results vary by site and over time: independent testing across the industry shows that no removal service removes everything, and removed information often reappears when brokers re-collect public records. We do not guarantee any particular removal outcome, and the service does not prevent or reduce unlawful calls or texts. The 90-Day Sweep runs for 90 days from purchase and then stops; it does not renew. Subscriptions renew and are cancelled through your app store account, and refunds for these purchases are handled by the app store. Cancelling stops removal processing immediately.

7. Acceptable use

You agree not to use Birln Wall to:

• break any law, or facilitate harassment, fraud, or abuse of others;
• evade lawful contact (for example, by law enforcement or the courts);
• send unlawful, deceptive, or unsolicited bulk messages;
• interfere with, overload, or attempt to gain unauthorized access to the service; or
• resell or commercially exploit the service without our written permission.

We may suspend or close accounts that violate these Terms.

Fair use and service limits. Birln Wall is for personal, individual use. Some features — including voicemail recording and delivery, voicemail-to-text, and automated call analysis — cost us money each time they run, so they are provided subject to fair use. We apply reasonable limits to protect the service and to stop abuse: for example, we cap how many voicemail notifications we send you in a day, and we limit how often the same unknown caller can leave you a voicemail. These limits exist so that a spammer dialing you repeatedly cannot run up cost or flood you with messages. If your use is abnormally high, automated, resold, or otherwise inconsistent with ordinary personal use, we may rate-limit, throttle, or temporarily suspend the affected feature, and we will try to tell you when we do. We may set and adjust specific limits over time. Reaching a limit never stops your wall from screening calls, and never deletes a voicemail that was already recorded.

8. Not for emergencies

Birln Wall is not a telephone service and must not be relied on for emergency calls. It does not replace your carrier line and cannot be used to reach 911 or other emergency services. Always keep a working phone for emergencies.

9. Service availability

We work to keep the service reliable, but we provide it "as is" and do not guarantee that every call or message will connect or that the service will be uninterrupted or error-free. We may modify, suspend, or discontinue features at any time.

10. Disclaimers & limitation of liability

To the fullest extent permitted by law, Phlout LLC disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. To the fullest extent permitted by law, our total liability arising out of or relating to the service will not exceed the greater of the amounts you paid us in the prior twelve months or US $50. We are not liable for indirect, incidental, or consequential damages, including missed calls or messages.

11. Indemnification

You agree to indemnify and hold Phlout LLC harmless from claims arising out of your misuse of the service or your violation of these Terms or applicable law.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the date above and, for material changes, provide notice in the app or by email. Continued use after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Minnesota, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Minnesota, unless applicable law requires otherwise.
